Invitation : Online workshop: Court case against Uber for unfair pay set by AI algorithm

Dear colleagues, 

With this email, I would like to inform you about our cooperation with  Worker Info Exchange International (WIE) , which last week issued Uber a formal Letter Before Action – the first collective legal move of its kind on behalf of Uber drivers in the UK and Europe. The letter demands that Uber halt its use of AI-driven dynamic pay systems, which have significantly reduced driver income since 2020. 

Affecting potentially 100,000 Uber drivers in the UK and many more across Europe, the claim sets out how the company has breached data protection law through the use of automated decision-making to set pay in real time by way of its so-called ‘Up Front Pricing’ systems. The case challenges Uber’s use of algorithmic pay-setting, which has left the majority of drivers earning less, stripped of income predictability, and suffering significant emotional distress due to opaque, data-driven systems. 

The research conducted in UK found that: 

  • 82% of longer-serving UK drivers now earn less under dynamic pay and lost 8-16%of income.

  • Uber’s commission often exceeds 50% of fares, compared to the historical 25%. 

  • Dynamic pay has destroyed drivers’ ability to anticipate income, eroding control over when and where to work. 

Now, more data is needed from across Europe!

We would like to invite you to an online workshop where we will present the upcoming research and data collection that is planned in Europe and explore how your organisation can support and benefit from it. 

The meeting will take place online on 12th December 10:00 CET and will include interventions from: 

  • James Farrar, Director of WIE

  • The University of Oxford, which conducted the research  

  •  Representatives of FNV and TUC already participated in the data collection

  •  Tea Jarc, ETUC 

The workshop is open to all ETUC affiliates who work, support, organise or have an interest in organising Uber drivers.
